Customer Terms, Data Processing Agreement, Privacy Agreement

We wanted to let you know that from 25 May 2018 onwards, we will be updating our agreements with you. Most of the changes relate to compliance with a new EU privacy regulation called the General Data Protection Regulation (GDPR).

 

Please take a moment to have a look at our new Customer Terms, Data Processing Agreement and Privacy Policy. This is a notification only, you don’t need to do anything else but if you continue to use Formitize from 25 May 2018, we’ll assume you’ve read and agreed to them.

 

A quick summary of the changes are below:

  • Customer Terms

We have replaced our Terms of Use with our new Customer Terms policy which includes links to the Data Processing Agreement and has improved explanations of ownership, administration and your responsibilities. We ask you to please read the Customer Terms carefully to make sure you are up tp date and understand the changes. In particular, the Customer Terms explain what data can and perhaps more importantly, cannot be stored in Formitize and related products.

  • Data Processing Agreement

In May this year, a new EU privacy regulation called the General Data Protection Regulation (GDPR) will come into effect. The new regulation will, by default, impose tougher obligations for organizations when handling personal data of EU citizens. Our new Data Processing Agreement (DPA) explains our responsibilities as the Data Processor of the data you hold on your Formitize account and your increased responsibilities as the Data Controller. Even if this new legislation doesn’t directly affect you or your account we recommend you understand the changes coming into effect.

  • Privacy Agreement

As we are responsible for the personal data you add to Formitize when register with us, we are also required to make amendments to our Privacy Policy, in accordance with the GDPR. These changes have been reflected in the new Privacy Agreement.

The requirement for these changes may not be relevant for you particularly if neither you, nor your clients reside in the EU or UK, however many of the changes are good industry practices and their adoption will assist in the compliant treatment of data.
